1. Acceptance of Terms

By accessing and using AgentEQ ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

AgentEQ is an AI-powered automation platform that provides intelligent customer service solutions, chatbot services, and automated workflow management. The Service includes:

  • AI-powered customer service automation
  • Intelligent chatbot creation and management
  • Workflow automation tools
  • Analytics and reporting features
  • API access and integrations
  • Customer support and documentation

3. User Accounts and Registration

3.1 Account Creation

To access certain features of the Service, you must create an account by providing accurate, current, and complete information during the registration process.

3.2 Account Security

You are responsible for safeguarding the password and for all activities that occur under your account. You agree to:

  • Maintain the security of your account credentials
  • Immediately notify us of any unauthorized use of your account
  • Ensure that you exit from your account at the end of each session

3.3 Account Verification

We may require email verification before you can access certain features of the Service. You agree to provide valid contact information for verification purposes.

4. Subscription Plans and Billing

4.1 Subscription Tiers

AgentEQ offers multiple subscription plans with varying features and usage limits. Current plans include individual platform plans, bundle packages, and custom solutions.

4.2 Free Trial Period

New customers are eligible for a 14-day free trial period after their initial payment. During this trial period:

  • You have full access to all features included in your selected plan
  • No additional charges will be applied during the trial period
  • Your paid subscription will begin automatically after the 14-day trial period ends
  • You may cancel during the trial period to avoid future charges

4.3 Billing and Payment

All payments are processed securely through Stripe. Subscription fees are billed in advance on a monthly basis. You authorize us to charge your designated payment method for all fees associated with your subscription.

4.4 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings.

4.5 Refund Policy

Refunds are only available for first-time subscriptions and only during the 14-day free trial period. This policy applies as follows:

  • Refunds are only permitted for customers who have never had a previous subscription with AgentEQ
  • Refund requests must be submitted during the 14-day free trial period
  • No refunds will be provided after the trial period has ended
  • No refunds will be provided for subsequent subscription renewals
  • Refund requests must be submitted through our customer support channels
  • Approved refunds will be processed within 5-10 business days

This refund policy is designed to ensure fair usage of our trial system and maintain the integrity of our service offerings.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Transmit harmful, threatening, abusive, or defamatory content
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use the Service for any illegal or unauthorized purpose
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Create competing products or services
  • Transmit spam, viruses, or malicious code

6. Intellectual Property Rights

6.1 Our Content

The Service and its original content, features, and functionality are and will remain the exclusive property of AgentEQ and its licensors. The Service is protected by copyright, trademark, and other laws.

6.2 User Content

You retain ownership of any intellectual property rights that you hold in content you submit to the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, modify, and distribute your content in connection with the Service.

6.3 Feedback

Any feedback, comments, or suggestions you provide regarding the Service may be used by us without any obligation to compensate you.

7. Data Privacy and Security

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We implement appropriate security measures to protect your data, but cannot guarantee absolute security.

8. Service Availability and Modifications

8.1 Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or other operational reasons.

8.2 Service Modifications

We reserve the right to modify or discontinue the Service at any time, with or without notice. We will make reasonable efforts to provide advance notice of significant changes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTEQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. AGENTEQ DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to defend, indemnify, and hold harmless AgentEQ and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

13. Governing Law and Jurisdiction

These Terms shall be interpreted and governed by the laws of the jurisdiction in which AgentEQ operates, without regard to conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of that jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

16. Severability

17. Entire Agreement

These Terms constitute the entire agreement between you and AgentEQ regarding the use of the Service and supersede all prior and contemporaneous written or oral agreements between you and AgentEQ.
